Draft for legal review — not yet in force

This is a working draft. A lawyer has not reviewed it yet, and it does not apply until it is published as final. Points marked "[to confirm]" are still open.

This draft is in English; translations will follow the legal review.

1. About these terms

These terms are an agreement between you and [company name], [registered address] ("proQer", "we", "us"). They apply to the proQer website and app. By creating an account or using proQeryou accept them. Our privacy policy explains how we use your data.

proQer is a platform where people find, compare and publish property and talk to each other. We are not a party to any sale, rental or service agreed between users, and we are not an estate agent, broker, lender or adviser. [to confirm with counsel]Whether any local licence or registration is needed to run the platform in each market (for example Turkey or the UAE).

2. Who can use proQer

  • You must be at least 18 and able to make a binding agreement. [to confirm]The minimum age. Sign-up asks people to confirm they are 18 or older; it does not check it.
  • Accounts are for buyers, sellers (agents, developers and owners), service providers and companies. Choose the role that is true for you. Professionals must hold any licence their work requires where they work. [to confirm]Whether we check licences, and what the "verified" badges mean.
  • If you use proQer for a business, you accept these terms for that business as well.
  • We may refuse or close accounts that break these terms or the law.

3. Your account

  • Give true information and keep it up to date. One account per person; don't share your sign-in.
  • You may sign in with a password or with Google. Keep your password safe; a session lasts up to 7 days, and you can sign out on every device at once.
  • You are responsible for what happens in your account. Tell us at once if you think someone else has used it.

4. Listings

If you publish a listing, you promise that:

  • you own the property or are allowed to market it, and the property is really available;
  • the price, currency, size, address, photos and description are true and not misleading, and you update or remove the listing when they change or the property is sold or let;
  • you have the rights to the photos, videos and text you upload, and they don't show people who haven't agreed to it;
  • the listing follows the advertising rules where the property is. [to confirm with counsel]Market-specific rules to name (for example licence numbers in listings).

We show prices in the seller's currency and also converted into the viewer's currency and area unit; conversions are approximate and the seller's own price ("Listed at") is the one that counts. We may translate listings automatically, resize photos, and add area information (such as places nearby). Draft and pending listings are visible only to you and our admins. We may refuse, unpublish or remove a listing that breaks these terms.

5. Posts, reels, inquiries and comments

  • Posts and reels (with photos or video) can be published only by sellers (agents, developers, owners), service providers and companies.
  • Inquiries are text only and open to everyone: a buyer asking for something specific, an agent asking other agents for listings, or anyone asking for help in another market. They can name a city or district, a budget range, a property type and a purpose. A buyer's inquiry shows their name or stays anonymous (for example "A buyer from Germany"), following their privacy settings.
  • Sellers answer inquiries only in public: with comments, optionally attaching one of their own live listings. Sellers may never use an inquiry, a comment, a profile or anything else on the social side to message a buyer, find a buyer's contact details or reach a buyer privately.
  • The buyer decides. A buyer can look at a seller's profile and listings, then contact the seller through the contact flow (next section).
  • Contact details and links are removed automatically from inquiries and comments. Don't try to get around this (for example by spelling a number out).
  • A comment can be up to 1,000 characters. We limit how many comments, follows and other actions an account can make in a short time.

6. Contact between buyers and sellers

  • Contact request (free plan): a buyer asks one seller to get in touch and agrees to share their name, email and phone with that seller. The seller sees the request without these details and accepts it by unlocking the lead with credits; only then are the details shared. The buyer can withdraw a request until it is accepted. Requests expire after 14 days.
  • Direct messages (paid plans): the buyer starts the chat; a seller can't start a chat with a buyer. Once a buyer starts a chat, both can write. Contact details, links and words like "WhatsApp" are hidden in messages.
  • You can block or mute anyone. Blocking doesn't cancel a buyer's pending contact requests, so a seller can't learn who sent one.
  • Use contact details you receive only to talk about the property or service the buyer asked about. Don't spam, resell or pass them on. [to confirm with counsel]Sellers' own duties under data protection law for the buyer details they receive.

7. Paid plans, credits and boosts

Plans

  • Prices and what each plan includes are on the pricing page. Payments are handled by Stripe.
  • Paid plans renew automatically at the end of each period until you cancel. You can cancel in the billing portal; the plan then runs to the end of the period you paid for and doesn't renew.
  • [to confirm with counsel]Refunds for plans (for example a cooling-off period for consumers), taxes and VAT, the currency we charge in, and how we tell you about price changes.

Credits

  • Credits pay for things such as unlocking a lead, boosting a post and some Anya use. What each costs is shown before you use it.
  • Plan credits come with a plan and expire at the end of the plan period. Purchased credits never expire.
  • Credits have no cash value and can't be transferred or exchanged for money. [to confirm with counsel]Refunds for unused purchased credits when an account is closed.

Boosts and refunds

  • A boost promotes a post for a number of days within a budget of credits. Promoted posts are labelled "Promoted".
  • Boosting a post again adds to its running or paused boost. A boost at a different tier is refused while one is running.
  • If a boosted post is deleted (by you, or by us for a reason other than breaking the rules), you get back the smaller of the unused share of its days and the unused share of its budget. A paused boost refunds what is left. Credits go back where they came from: purchased credits as purchased credits, plan credits as plan credits (which lapse if their plan period has ended). A post is refunded only once.
  • No refund when we remove a post because it broke these terms.

8. Anya and AI features

  • Anya and proQer's insights (prices, yields, market and area information, residency and citizenship thresholds) are general information. They are not financial, investment, legal, tax or immigration advice.
  • AI answers and automatic translations can be wrong, incomplete or out of date. Check important facts with the seller and with qualified professionals (a lawyer, a licensed agent, a tax adviser) before you decide or pay anything.
  • Anya answers from the listings and data on proQer; a listing's details come from its seller.
  • Anya use may be limited by your plan or use credits. Don't try to make Anya produce harmful or unlawful content, and don't put other people's personal data into it.
  • AI features run on Google's Gemini today; the privacy policy explains what this means for your data.
  • [to confirm with counsel]Liability wording for AI output.

9. What is not allowed

  • Fake, duplicate or misleading listings, prices or profiles; bait listings for properties that aren't available.
  • Fraud, scams, asking for payments outside an agreed and lawful process, or money laundering.
  • Harassment, threats, hate speech, discrimination (for example refusing buyers or tenants for their origin or religion), sexual or violent content.
  • Sharing other people's personal data without their permission, or collecting users' data (including by scraping or bots).
  • Spam, unsolicited advertising, and getting around the contact rules (for example sellers contacting buyers privately, or hiding contact details in text or images).
  • Content that infringes someone's copyright, trademark or other rights.
  • Breaking or testing the security of proQer, overloading it, or getting around limits, plans or credits.
  • Anything unlawful where you or the property are.

10. Moderation and removal

  • Our admins may remove posts, reels, inquiries, comments and listings. When an admin deletes someone else's post they record one of these reasons: it broke the rules, the author asked, a duplicate, a mistake, or another reason. Only "broke the rules" withholds a boost refund.
  • We may suspend or ban an account that breaks these terms. Its posts and comments are hidden while the suspension or ban lasts, and its chats become read-only. Lifting it brings back exactly what was hidden.
  • To report content or an account, use Report on it, or contact us. [to confirm]How fast we review reports, and how a user can appeal a decision.

11. Content and intellectual property

You keep the rights to what you publish. You give us a worldwide, non-exclusive, royalty-free licence to host, show, translate, adapt (for example resize or crop) and distribute it on proQer and in promoting proQer, for as long as it is published and for a reasonable time after. [to confirm with counsel]Scope and duration of the licence.

proQer's software, design, brand, and the data and analysis we produce belong to us or our licensors. Don't copy, scrape or resell them without our written permission.

12. Services of other companies

proQer uses other companies' services, such as Stripe for payments, Google for sign-in and AI, Mapbox and Google Maps for maps and Cloudinary for media. Their own terms apply to your use of them. Links to other websites are for convenience; we don't control those sites.

13. Disclaimers and liability

proQer is provided "as is". We work to keep it running and correct, but we don't promise that it is always available, free of errors, or that listings, prices, market data or AI answers are complete or accurate. Users are responsible for their own listings, posts and dealings with each other.

[to confirm with counsel]Limitation of liability (amount cap, excluded losses), the rights consumers keep under their local law, and an indemnity from users who break these terms.

14. Ending your account

  • Buyers can delete their account in their dashboard. It can be restored by signing in again within 30 days; after that it is erased, as the privacy policy explains. A paid plan stops renewing when you delete the account.
  • Sellers, service providers and companies can ask us to close their account. [to confirm]Self-service closing for these accounts.
  • We may suspend or close an account that breaks these terms, or if the law requires it. [to confirm with counsel]Notice periods, and what happens to paid plans and credits when we close an account.

15. Changes to these terms

We may change these terms. We will update the date at the top and tell you in proQer before an important change applies; if you keep using proQer after that, the new terms apply. [to confirm with counsel]How far in advance.

16. Governing law and disputes

These terms are governed by the law of [country], and disputes go to the courts of [city], without taking away the protection consumers have under the law where they live. [to confirm with counsel]Governing law, courts or arbitration, and online dispute resolution notices.
